Are You Sabotaging Your Personal Injury Claim?

Are you sabotaging the amount of compensation that you could receive for your personal injury claim?  We all know that some accidents can definitely be life-changing and it may seem that no amount of money could ever compensate for the quality of life lost.
At The Law Offices of Deanna McFarlane, we believe in achieving the best compensation for our clients for personal injury claims.  As such, here are common mistakes commonly made by the injured parties that could compromise the claim.
These are commonly made mistakes as follows:
1. Receipts- The receipts are evidence of out-of pocket expenses. Not keeping your receipts will affect the amount claimed for these expenses as the receipts are evidence of the amount of money spent. Examples of receipts to be kept are receipts for: medical reports, police reports ,medical expenses and household help if needed as a result of the injuries.

2. Medical reports- Medical reports are the evidence of the injuries received that makes the direct causal connection between the injuries sustained and the injury/accident. Accordingly, it is important to go to the doctor quickly after the injuries are sustained. Upon  visiting the doctor, it is critical to disclose to the doctor all the injuries that you are experiencing and also whether you had any previous injuries prior to the accident.
3. Police reports- Police reports provide an account of the accident and are useful and sometimes critical in establishing liability. It is important to report the accident and retrieve the police report to carry to your attorney. It will help in determining issues such as whether to pursue settlement or litigation or to simply advise the party that they do not have a case.
4. Witnesses- Should the matter end up at court/litigation it is important to recall whether there were any witnesses that could support your version of events and also retrieve their contact information. After all, they could be critical in your case especially where it is highly contested .
5. Follow up treatments- Should the need for follow-up treatments eg: physiotherapy, specialists, psychiatric visits etc. it is critical to pursue these if the funds permit as they would affect significantly the amount of money that your lawyer can negotiate on your behalf.
6. Evidence- It is imperative to keep the evidence in relation to the accident/incident. Useful evidence for examples are photographs for accident claims of the scene, or of the injuries to give examples. In the case of food poisoning, to keep the food samples.
